I am a trainee solicitor and have a conviction for drunk driving. I have not told my firm about this conviction as it occurred after I had commenced my training contract. I am due to qualify in a few months and wanted to know whether this will affect my chances of pursuing a legal career?
The Law Society will send you a AD1 form which you must complete before your are admitted as a solicitor. This contains a section asking you to disclose any criminal convictions whether or not they are spent. You are under a duty to disclose this information to the Law Society so that they may determine whether you are a 'fit and proper' person to become a solicitor. The Law Society has a list of minor offences and serious offences. If your conviction is classified as a minor offence you will not be hindered from pursuing a legal career. In some cases the matter can be resolved fairly swiftly without any delay being caused to your admission date. Sometimes it may be necessary for an adjudicator to become involved but this all depends on the severity of the offence. It is advisable to tell your law firm about this conviction as you have a duty of good faith to them as your employer and it is best to be honest with them.
